Driver charged in brother’s death

An early morning accident in rural Pike County Sunday claimed the life of a 20-year-old Brundidge man and leaves his brother charged with his murder.

Luiz Texcahua was a passenger in a 1997 Ford Explorer driven by Fabian Texcahua, 21, of Brundidge. Luiz was ejected from the vehicle after his older brother lost control and the vehicle began to roll, according to a press release from the Alabama Department of Public Safety.

The single-vehicle accident occurred around 5:30 a.m. about four miles south of Troy on County Road 5520.

An initial investigation indicates that the vehicle was traveling over the speed limit when the driver ran off the road and over-corrected as he attempted to bring the vehicle back into the roadway.

Luiz Texcahua was ejected out the passenger side window. He was pronounced dead at the scene by Pike County Coroner Gary Williams.

Fabian Texcahua was charged with murder and placed in the Pike County jailed with a $50,000 bond. Alcohol is believed to be a factor. Alabama State Troopers continue to investigate the circumstances surrounding the crash.

I would like to clarify something from my perspective. While I do not feel we do a good job regulating illegals - both on a local and national level - I have only had positive experiences with the law enforcement in Enterprise. As a law abiding citizen, my contact with them in a professional matter has been very limited. My daughter was in an accident and the officer was wonderful. I also was pulled over for speeding, going 34 right as the speed limit changed from 40 to 25 but the officer gave me a warning which I really appreciated since I fully expected a ticket. Also, I have a ditzy friend who got gas recently and totally forgot to pay. When the officer ran her tag he knew who she was, contacted her and she immediately went and took care of the problem. She simply forgot to pay because she was running late for work. I love Enterprise and we have wonderful public servants. These folks get paid next to nothing to put their lives on the line for us daily and I really appreciate their service. We need to not tie their hands when it comes to dealing with illegals and those who continually break the law. We need tougher laws put in place by our elected representatives who seem to think getting elected is just becoming some elite member of a special club. They forget who they are accountable to. US!

“Patriot.Gyrl65” you are right on! As well as pretty much everyone that has posted to this article. Police officers are supposed to “protect and serve”, but it seems that the “protect and serve” only applies to fellow officers, politicians, and well known or well off people. If you are a just a “regular citizen” you’re screwed. It doesn’t matter if you have a good back ground and have never been in trouble for anything. They will still nail you to the wall any way they can. There are no “investigations” no matter what they may tell you. The police chief decides what supposedly happened, gives his press release on the (his) findings, and there you go. Unless you have the money to hire a good attorney to fight the charges, you’re screwed. Police officers these days can do anything they want to and nothing is done. But a “regular citizen” can go to the gorcery store to pick up milk and be arrested for what ever reason! It’s rediculous and pathetic!

My thoughts and prayers go out to the family. No matter where you’re from, you’re still a human being. May God help us all…..

Well, darn folks, don’t you know that the local yocal cops around here can do anything they want to.  The laws that apply to you and I do not apply to the “law enforcement officers”. 
They are always innocent of all charges regardless the circumstance or situation.
Name one cop in this area that has faced serious charges for their bad behavior? One guy who stole some stuff.  But let one of them do bodily injury to someone else and the excuse is always “I was doing my duty”.
Well, you cops need to remember who pays your paycheck…it is us the citizens and our tax dollars.  You need to serve and protect US not the other way around.  Everyone is not guilty of a crime or even thinking of a crime and you all need to stop treating all of us innocent TAXPAYERS with the RESPECT we DESERVE for giving you the awesome responsibility you have.  You wouldn’t have it without us.
Some people are criminals, but the vast majority of us aren’t and we don’t appreciate it when you are pulling us over for “speeding” or whatever other excuse you can come up with, WITH YOUR HAND ON YOUR GUNS READY TO SHOOT US IF WE MAKE THE “WRONG” MOVE. I for one am sick of seeing the arrogant behavior of the majority of cops that I interact with. You are no better than the citizens you are supposed to be serving.

As far as the guy who killed the couple in Enterprise, I think justice is worth the cost. I don’t care if they seek the death penalty and charge him for murder. The opportunity to deport him was two years ago when he was pulled over and fined for driving without a license. At that time he should have been deported. Our current system does not want to deport these illegals. If they did, they could just sit in front of the drug or grocery stores or the local ER. They are not hard to find. How about starting to crack down on businesses that employee these people if we aren’t going to do anything about the people sneaking in here? I know many people who have been in accidents caused by illegal aliens driving - which, by the way, they do not seem to be very good at! They all flee and nothing is ever done to them. My mother was one of the victims in another accident. Thankfully, she is okay.

If your child and his/her spouse were killed this way would you want justice? Or, would you just want him to get sent back to Mexico so he could come back next week?

As far as the guy who was in the accident that killed his brother, deport him. Just know he will be back - drinking and driving and you might be his next victim.

Thats great thinking guys!! We’ll just put him in prison at a cost of $80,000 a year for medical,food,clothes,etc,,,, Why not just DEPORT the guy??

And did you notice, Amazed, that not only did the illegal in Enterprise get charged with manslaughter and the one in Troy was charged with murder, but that a Louisville policeman ran over a man and killed him and there is not even mention of an investigation into any charges?  Either we aren’t being told the entire stories or there needs to be some major overhaul in making charges pressed more uniform.

Why is this illegal charged with murder (of another illegal and his own brother who was with him willingly) and the illegal who killed two innocent American citizens in Enterprise is only charged with manslaughter?! This is an outrage!

When I was growing up, I was a partier/drinker and always ran with a rough crowd, hard drinking and racing, hot-rod, fast cars etc. Yes, we all drank and drove. I told all my family members that if i was ever hurt or killed while riding with anybody on my own free will, to be sure that they made sure that they DID NOT pursue “ANY” charges against that person! I saw several peoples lives ruined forever because of it, and it is not right, if the person was in the vehicle on their own, especially a family member. Yes, the State should pursue charges, but NOT murder! Luckily, I grew out of that stage and was never hurt, and never hurt anyone else.I will tell anybody that it is STUPID to drink and drive, as well as stupid to talk on the phone, and other things while driving.
