A 24-year-old Dothan man recently had his 70-year prison sentence cut in half after his attempted murder charge was dismissed as part of an Alabama Criminal Court of Appeals ruling, according to his attorney.
Attorney Derek Yarbrough said his client, Jason Murphy, had his attempted murder charge dismissed, which stemmed from a shooting at the PrimeCare business formerly on Westgate Parkway in Dothan in 2007.
Yarbrough said his client’s three other felony charges were affirmed by the criminal court of appeals, which he said included second-degree burglary, making a terrorist threat and criminal mischief.
Circuit Court Judge Butch Binford originally sentenced Murphy to 35 years for the attempted murder offense, but he will now only serve the 35 total years for the remaining three offenses.
Murphy, who was an Alabama National Guardsman at the time, entered the office in February 2007 with multiple weapons and opened fire. No one was killed or seriously injured in the shooting. After a standoff, Murphy surrendered to police. Murphy later told police he went to the office because he was upset that he was not being deployed to Iraq.
