A Dothan man received a 198-year prison sentence on Wednesday for sodomizing and molesting an 8-year-old girl.
Houston County Circuit Court Judge Butch Binford sentenced 33-year-old David Anthony Poole for convictions for felony first-degree sodomy and felony sex abuse of a child under the age of 12. A jury convicted Poole in December.
Assistant Houston County District Attorney Banks Smith asked the court for the maximum sentence for each charge. Smith submitted two prior convictions to the court for Poole, which included a felony second-degree robbery offense.
Binford said the prior convictions enhanced Poole’s possible sentence to 99 years or life in prison for the sodomy conviction, and 15 to 99 years or life in prison for the sex abuse conviction.
Thomas Smith, who represented Poole in court, asked the court to consider a sentence in the lower range.
Binford sentenced Poole to 99 years for each charge, which he ordered to be served consecutively. He said there will be no probation or appeal bond considered in the case.
Banks Smith said the jury returned a split verdict in the felony cases filed against Poole. He said the jury found Poole not guilty of a felony first-degree rape charge and felony incest charge.
Houston County Sheriff’s investigators arrested Poole on Dec. 2, 2010, on the four felony charges.
